What HSE says

ACoP L8 says the assessment should be reviewed regularly, and specifically whenever there is reason to believe it is no longer valid. There is no set expiry date in law. Many organisations adopt a two-year review as good practice, with higher-risk sites reviewing annually.

Triggers for an immediate review

  • Changes to the water system or its use
  • A change in the use of the building
  • New information about risks or control measures
  • Monitoring results showing controls are not working
  • A change of key personnel, such as the responsible person
  • A case of legionellosis linked to the system
  • A change in the people at risk, such as vulnerable occupants moving in

Rental properties

For landlords, a sensible approach is to review at each change of tenancy or every two years, and after any work on the boiler, cylinder or tank.

Frequently asked questions

Does a legionella risk assessment expire?

Not on a fixed date. It stays valid only as long as it accurately reflects the system and the risks.
