Landlords have a legal duty to assess and control the risk from legionella in their rental properties. How often

Review when something changes, such as a new boiler, alterations, a change of tenant type or a long void. Many agents review at each new tenancy or every two years.

Legislation and standards

Health and Safety at Work etc. Act 1974 (section 3), COSHH Regulations 2002 and ACoP L8. In Scotland, the repairing standard guidance also expects legionella risk to be assessed.

Frequently asked questions

Is there a legionella certificate for landlords?

No. There is no legal legionella certificate. A written risk assessment is the usual evidence that you have assessed the risk. See our certificate guide.

How much does a landlord legionella risk assessment cost?

Published UK prices for a standard flat or house are typically £70 to £200 plus VAT, with HMOs and blocks costing more. See our cost guide.

Do landlords legally need a legionella risk assessment?

Landlords must assess the risk. HSE does not insist on a certificate or a particular format, but you need to be able to show the risk has been assessed and controlled. A written record is the simplest way to prove it.

Do I need to test the water?

Testing is not normally required in domestic lets. Keeping hot water hot, cold water cold and water moving is what controls the risk.
