Who Can Carry Out a Legionella Risk Assessment?

The law does not name a particular qualification for legionella risk assessors. It asks for competence. Here is what that means and how to check it.

The legal test: competence

ACoP L8 requires the risk assessment to be carried out by a competent person, meaning someone with the right skills, knowledge and experience for the system being assessed. A simple flat needs far less than a hospital.

Can landlords do their own?

Yes. HSE says landlords can assess their own properties if they understand the risks and how to control them. Many choose a professional for complex properties, HMOs and portfolios, or simply for an independent record.

Useful signs of competence

  • Recognised legionella risk assessment training
  • Experience with similar buildings and systems
  • Work that follows ACoP L8, HSG274 and BS 8580-1
  • Membership of a recognised industry scheme
  • Professional indemnity and public liability insurance
  • Sample reports you can review before booking

Questions to ask a provider

  • Will the assessor visit and survey the whole system, including tanks and plant?
  • Will I get a schematic, photographs and a prioritised action plan?
  • How are out-of-range temperatures dealt with?
  • Can you carry out the remedial work and monitoring as well?

Frequently asked questions

Do you need a qualification to do a legionella risk assessment?

There is no single mandatory qualification. The assessor must be competent for the system, which usually means relevant training and experience.

Can a plumber do a legionella risk assessment?

A plumber can if they are competent in legionella risk assessment. Plumbing skills alone are not the same as risk assessment competence.
